Information on Data Protection
(According to Art 14 GDPR )

Regarding the research project “Picturing Migrants’ Lives” the exception according to Art 14 5. (b) GDPR applies as the provision of such information to each data subject that is depicted on an image proves impossible or would involve a disproportionate effort for OeAW. However, OeAW took appropriate measures to protect the data subject's rights and freedoms and legitimate interests and makes the information according to Art 14 GDPR publicly available. In all cases, the image material is checked to ensure that the interests of the persons depicted have been considered in terms of respectful representation. Any possible unfavorable, degrading or embarrassing depictions or representations that violate the privacy of a persons depicted was excluded from publication.

Sources, Purpose and legal basis:

The personal data collected in the framework of the project are processed for the purpose of the “Picturing Migrants’ Lives” research project.

Sources of data collection are Jovan Ritopečki’s photographic estate as well as publications, newspapers, and magazines.

Legal basis are the justified public and legitimate interests of ÖAW regarding scientific research (Art 6 paragraph 1 lit e and f GDPR in conjunction with the Austrian Academy of Sciences Act – ÖAWG, Austrian Data Protection Act - DSG and the Austrian Research Act -FOG).

The data may be used for future research purposes as long as these secondary purposes are in accordance with the GDPR and are compatible with the purpose for which the personal data was initially collected.

Recipients and storage period:

Personal data including images will be published on the image repository https://gams.uni-graz.at/vismig that is operated by the University of Graz and in various scientific publications.

Images and publications based on the data will be stored indefinitely.

Furthermore, the data will be stored for the purpose of research, documentation and the proof of good scientific practice at least for ten years or until the justified objection of a data subject.

Information about the rights of data subjects:

Data subjects have the right to request access to and rectification or erasure of their personal data, the right to request restriction of processing or to object to processing as well as the right to data portability. Moreover, they have the right to lodge a complaint with the data protection authority in Austria (https://www.dsb.gv.at/) or the competent authority in another EU member state.
